Carriage clause

When using the Express Service, the customer, as the shipper, is deemed to have agreed to the terms of this clause from the moment LX Pantos accepts the shipment, unless the customer has entered into a written agreement with an LX Pantos manager who has been duly authorized to act on behalf of the customer or any relevant interested party regarding the shipment. The customer’s legal rights and authority are not affected by the specific form of service provided (even if it involves additional costs). 1. clearance, import and export LX Pantos may perform the following activities on behalf of Song Ha-in to provide the Express service. (1) This involves preparing documents, correcting product or service codes, or paying duties or taxes under relevant laws and regulations, and (2) Acting as the consignee for the purpose of designating a customs broker to handle the shipper’s export clearance, act as an agent for export control purposes, or handle the consignee’s import clearance and registration (3) The carrier may hand over the goods at the request of a third party deemed to have legitimate authority in the event of any of the following circumstances. If the recipient at the final delivery address is not present If direct delivery to the recipient is not possible due to security concerns at the final delivery location (e.g., document reception desk, security office, etc.) 2. Prohibited Items We do not accept (or handle) the following items. Items classified as poisons, dangerous goods, or prohibited or restricted items by the IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), relevant national governments, and other related organizations. Failure to file a customs declaration when required by customs regulations. Items that are deemed unsafe or illegal to transport (such items include, but are not limited to, animals, cash or securities, precious metals, explosives, military supplies, human remains, pornography, and illegal drugs or narcotics). 3. Delivery and Non-Delivery Shipments will be delivered to the recipient address provided by the shipper (however, for postal services, delivery will be made to the first receiving post office); the recipient does not necessarily have to be an individual. Shipments designated for a central collection area will be delivered to that area. If any of the following circumstances occur, the carrier will make reasonable efforts to return the shipment to the consignee; however, any related service fees or administrative costs will be charged to the shipper. Recipient refuses to accept the shipment The recipient refuses to pay the relevant charges (freight, customs duties, and other legitimate shipping-related costs) If the shipment is deemed ineligible for handling under the customs regulations of the destination country, or if issues such as undervaluation arise during customs clearance, 4. Inspection The carrier may open and inspect the goods without prior notice to the shipper. 5. Freight and Freight Invoices Freight charges are calculated based on the greater of the actual weight or the volumetric weight, and items may be reweighed to ensure accurate billing. If freight is not paid prior to shipment, all charges must be paid within 7 days of receiving the invoice, or within such other period as agreed upon in writing between the shipper and LX Pantos. Unless otherwise proven, the invoice will be deemed to have been received within 3 business days of the invoice date. 6. LX Pantos' Liability LX Pantos and Song Ha-in agree that LX Pantos’ liability is strictly limited to direct losses and to the extent specified in this Article 6 based on the kilo/lb standard. All other types of loss or damage, including loss of business, interest, and future business, are excluded, even if such loss is special or indirect and even if the risk of such loss was notified to LX Pantos before or after receipt of the goods, as such special risks may be insured by the shipper. If a combination of air, land, or other modes of transport is used in the shipment, loss or damage to the goods shall be deemed to have occurred during air transportation unless proven otherwise. LX Pantos’ liability is limited to the greater of US$100 per shipment or the actual value not exceeding the standards below. For air transportation (excluding the United States), the rate is USD 20.00 per kilogram or USD 9.07 per pound. For ground shipping, the rate is USD 10.00 per kg or USD 4.54 per lb. Claims for compensation regarding shipments are generally limited to one claim per shipment and constitute a full and final settlement for loss or damage. If you consider this compensation limit insufficient and do not wish to assume all risks of loss or damage to the shipment, you must declare the actual value separately and may request additional coverage as described in Article 8 below regarding insurance for the shipment, or arrange your own additional coverage. 7. Statute of limitations for claims for damages Claims for compensation against LX Pantos must be submitted in writing to LX Pantos by the recipient within 14 days of receiving the goods in the case of damage, and within 21 days in the case of delayed delivery or loss; otherwise, LX Pantos shall not be held liable. 8. Insurance for the Consignment If you request insurance and pay the applicable premium, we can arrange coverage for the actual cash value of any loss or physical damage to the goods. The insurance does not cover indirect losses or damages, or losses or damages caused by delays. 9. Delay of the Consignment The carrier will make every effort to deliver the customer’s goods in accordance with the carrier’s normal delivery schedule. The carrier shall not be liable for any damages resulting from delays, unless such delays are attributable to the carrier’s fault. Furthermore, under no circumstances shall LX Pantos be liable beyond the limits specified in Article 6 of this clause, nor shall it be liable for consequential damages, indirect losses, or special damages resulting from delays. 10. Uncontrollable Situations The carrier shall not be liable for any loss or damage arising from circumstances beyond its control. This includes the following situations: Natural disasters: earthquakes, storms, floods, fog force majeure: war, plane crashes, blockades of ports Characteristics or defects of the product itself: This applies even if you have reported the issue to LX Pantos. Riots or civil unrest Acts or omissions by parties other than the carrier, including the following: Song Ha-in Consignee Third party with a vested interest a. A clearance broker or clearance agency hired (engaged) by the consignee b. Persons who have a legitimate relationship with the recipient (e.g., coworkers, security staff, mailroom staff, etc.) Customs or government officials Strike Damage to or loss of electronic devices, photographic images, data, or records caused by electricity or magnetism 11. The Warsaw Pact and the Montreal Protocol If the shipment is transported by air to a final destination other than the country of origin or involves a stopover in a country other than the country of origin, the Warsaw Convention or the Montreal Convention may apply. In most cases, the Warsaw Convention and the Montreal Convention govern and limit the carrier’s liability for loss of or damage to the shipment. 12. Song Ha-in’s collateral and The shipper shall ensure that the carrier does not incur any loss or damage arising from any breach of the relevant laws and regulations or the terms and conditions set forth below, and the shipper shall be liable for any such loss or damage. The information provided by Song Ha-in and her representative must be accurate and complete. The shipment must be stored in a secure location by the shipper's employee. Ms. Song Ha-in should have a trusted employee prepare the shipment. Ms. Song Ha-in must ensure that there is no interference from unauthorized third parties throughout the entire process, from the preparation and storage of the goods to their delivery to LX Pantos. The shipment must be properly sealed, have the correct address, and be packaged in a manner that allows for proper handling during transit. All procedures must comply with applicable laws and regulations regarding customs clearance, import/export, etc. The bill of lading must be signed by the shipper's authorized representative, and its terms serve as the basis for imposing obligations on and binding the shipper. 13. Shipping Route Ms. Song Ha-in agrees to all transportation routes and conditions, including the possibility that the shipment may be transported via intermediate stops. 14. Governing Law Any dispute arising under this clause shall be subject to the exclusive jurisdiction of the courts of the country of origin, in the carrier’s favor, and the laws of that country shall govern. The shipper shall be bound by the aforementioned jurisdiction, unless prohibited by applicable law. 15. Independence of Provisions The invalidity or non-enforceability of any provision shall not affect the validity or enforceability of the remaining provisions of this clause.
